LEGAL DOCUMENTS
In the unfortunate event that a tenant fails to pay rent, the most important aspect to remember is that the correct action must be taken. It is essential that the correct letters must be sent and delivered, within the specified timeframes, in a manner which is acceptable to the Courts. The Landlord Legal team has successfully evicted many defaulting tenants which has resulted in a vast experience of all the requirements needed and procedures that must be adhered to. This is our service value and we would like to offer it to all agencies and their landlords!
RESIDENTIAL EVICTIONS
There is always the chance that even with all the actions taken by a landlord or his/her agent, that a tenant fails to remedy his/her breach of the lease agreement or alternatively fails to vacate the property after the appropriate notices were given. The next steps must be taken by a legal practitioner, such as an attorney. Landlord Legal has appointed a panel of attorneys and advocates that specialise in residential evictions, who will receive the instruction to proceed with the necessary legal action. These costs will be paid by Landlord Legal and includes all attorneys costs, all advocates costs and these costs are uncapped. If necessary, the landlord will only be liable for the Sherriff’s costs.
Collection of arrear rental and/or other amounts due
This is a separate process to the application for eviction. Landlord Legal will however pay 20% of the landlord’s legal fees if he/she decides to proceed with this process.
COMMERCIAL EVICTIONS
Similar to residential evictions, if a tenant fails to remedy his/her breach of the lease agreement or alternatively fails to vacate the property after the appropriate notices were given, then the next steps must be taken by a legal practitioner, such as an attorney. Landlord Legal has appointed a panel of attorneys and advocates that specialise in commercial evictions, who will receive the instruction to proceed with the necessary legal action. These legal costs will be paid by Landlord Legal and includes all attorneys costs, all advocates costs and these costs are uncapped. If necessary, the landlord will only be liable for the Sherriff’s costs.

R198/month
The membership subscription fee is R198 per month per property, inclusive of VAT, payable monthly in advance.
Evictions are costly and on average one will look at unopposed costs of anything between R30,000 and R40,000 excluding VAT. Costs of R100,000 and more for opposed evictions are also not unheard of. As a result, Landlord Legal protection is imperative for all agencies and property owners.
PRE-EXISTING NON-PAYING TENANTS
OR UNLAWFUL OCCUPIERS
We are more than willing to assist with the eviction of these occupiers and/or the summons for all arrear amounts, where the landlord is not a member of Landlord Legal.
