Similar to residential evictions, if a tenant fails to remedy his/her breach of the lease agreement or alternatively fails to vacate the property after the appropriate notices were given, then the next steps must be taken by a legal practitioner, such as an attorney. Landlord Legal has appointed a panel of attorneys and advocates that specialise in commercial evictions, who will receive the instruction to proceed with the necessary legal action. These legal costs will be paid by Landlord Legal and includes all attorneys costs, all advocates costs and these costs are uncapped. If necessary, the landlord will only be liable for the Sherriff’s costs.
Collection of arrear rental and/or other amounts due
In certain circumstances this is a separate process to the application for eviction. Landlord Legal will however pay 20% of the landlord’s legal fees if he/she decides to proceed with this process.
